Why POA documents get rejected in the UAE

Missing Arabic version

UAE authorities require documents in Arabic. A POA without a certified Arabic version is rejected regardless of its quality.

Wrong scope of powers

Powers that are too broad may be refused by banks or authorities. Powers that are too narrow may not cover the required transaction.

Incomplete notarisation chain when abroad

A foreign notary alone is not sufficient. The document must also be apostilled and attested at the UAE embassy and MOFA before it is valid in the UAE.

Expired POA

Property sale POAs are valid for two years. Property purchase POAs for five years. Using an expired document leads to rejected filings and lost deals.

Wrong authority registration

Some POAs must be registered with a specific emirate's authority. An unregistered POA may be refused even if correctly notarised.

Agent does not meet requirements

The agent must be a UAE resident aged 21 or above with a valid Emirates ID. If the agent does not qualify, the POA cannot be notarised.

What a POA Actually Does

A Power of Attorney is a legal document that authorises another person to act on your behalf. In the UAE, it must be drafted in Arabic or accompanied by a certified Arabic translation, and notarised by a UAE Notary Public to be legally valid. The scope of the document determines what the agent can and cannot do. A well-drafted POA specifies the exact powers granted, the relevant timeframe, and any limitations that protect you from exposure.

Getting a POA Done from Abroad

If you are outside the UAE, a local notary in your country is not enough. The correct process involves several steps: the document is notarised in the country of signing, then apostilled by the relevant national authority, then attested at the UAE embassy, and finally attested by the UAE Ministry of Foreign Affairs once it arrives in the UAE. Missing any step in this chain results in the document being rejected. E-notarisation through a UAE Notary Public via video call is now available and removes most of the authentication chain for straightforward cases.

How to Limit the Scope and Protect Yourself

A well-structured POA addresses the concern of granting too much authority. It specifies the exact transactions covered, the duration of validity, and any excluded powers. A property POA, for example, can be limited to a single property, a single transaction type, or a defined time window. This gives the agent exactly what they need and nothing more.

MOFA Attestation and When It Is Required

MOFA attestation is required when a document signed or notarised outside the UAE needs to be used by a UAE government authority. This applies to POAs signed abroad that will be used with DLD, courts, or government departments. It is not required for documents already notarised by a UAE Notary Public within the country.
